PUBLIC NOTICE

Our client, M/s. SALES INDIA PRIVATE LIMITED (CIN: U29191GJ1985PTC007880), having its registered office at B. Jadhav Chambers, 2nd Floor, Ashram Road, Ahmedabad – 380009, Gujarat, is the lawful proprietor and owner of the registered Trade Mark(s) and Copyright in the name/style “SALES INDIA” (including its artistic work/logo, if any), protected under the Trade Marks Act, 1999 and the Copyright Act, 1957, in relation to, inter alia, retail/wholesale of consumer electronics, home appliances, after-sales services and allied business activities. SALES INDIA has been operating since 1971 and has built substantial goodwill, reputation and consumer trust, including through multiple outlets across Gujarat, including Ahmedabad, Vadodara, Surat, Rajkot and other key cities.

It has come to our client’s notice that false, misleading and unauthorised communications/ representations are being made and circulated in writing and/or orally, including through WhatsApp, social media, SMS, phone calls, emails, and in-person meetings, by certain unknown persons/entities/intermediaries, including brokers/agents, claiming/implying that “SALES INDIA” stores/business have been taken over, acquired, merged, transferred, partnered, franchised, or Org.

“SALES INDIA” remains independent, and no sale, takeover, merger, business transfer, franchise or partnership has occurred with any party, It is further learnt that certain persons/entities, directly or through brokers/agents/intermediaries, are approaching landlords/property owners and making oral/telephonic misrepresentations and/or spreading misleading information to lure, influence, or disturb leasing/tenancy decisions and to extract higher commercial gains by taking undue advantage of our client’s goodwill and legacy. Such conduct amounts to malafide misrepresentation, unfair competition, unauthorised exploitation of goodwill, and is actionable inter alia under trademark infringement/passing off and other applicable civil/criminal laws.

No person, broker, agent, intermediary, competitor or third party is authorised to use, represent, solicit, negotiate, or conduct any business under the name/mark “SALES INDIA” (or any deceptively similar mark), or to claim any association, takeover, franchise, dealership, partnership, business transfer, or authorisation on behalf of our client, except those holding written authority duly issued by SALES INDIA PRIVATE LIMITED.

The public and trade are advised not to rely upon any such false/misleading messages/claims (whether written or oral). Landlords/property owners/brokers/agents are specifically cautioned not to entertain any representation or negotiation by any person claiming to be connected with “SALES INDIA” unless the same is supported by written authorisation and independently verified from our client/undersigned.

Any person/entity copying, imitating, misusing, misrepresenting, or conducting business under the mark/name “SALES INDIA” or any deceptively similar mark, in relation to the aforesaid goods/services, without prior written authorisation, shall be treated as unauthorised, illegal and actionable, and shall be liable for civil and criminal proceedings, including injunction, damages, accounts of profits, delivery-up, and costs, at their sole risk and consequences.

Anyone having information regarding such misuse/misrepresentation is requested to inform our client at the registered office address mentioned above and/or the undersigned.

This Notice is issued in public interest and without prejudice to all rights, remedies and actions available to our client under civil, criminal, trade mark, copyright and other applicable laws.
